Terms & Conditions of Sale

No merchandise shall be returned without prior authorization and an authorization number. All packages received without an authorization number will be refused. All merchandise will be returned by UPS ground. Any additional costs incurred as a result of the use of overnight or second day delivery service will be at the Buyer’s expense. Buyer is responsible for shipping costs in returning the unit to Seller.

Used merchandise is non-refundable. Merchandise returned three (3) days from day received in original packaging is charged a 3% service fee. Any returns after three (3) days will be charged a 15% restocking fee on the merchandise returned up to ten (10) days. Shipping and handling fees are not refundable under any circumstances.

Buyer shall indemnify and hold Seller harmless from and against any claim which may be made by any person arising out of the purchase or use of any product or use of any product into which the merchandise covered by this order is ultimately incorporated. Buyer shall name Seller as an additional insured under any insurance policy relating to liability, which Buyer may have or may hereafter with respect to products using the merchandise covered by this order.

Buyer agrees, by acceptance of the product, that venue for all legal actions arising by virtue of the purchase shall be in Marion County, Florida, and the laws of the State of Florida shall govern all disputes. Buyer further agrees that, by acceptance of this product, Seller’s liability shall be limited to the purchase of the product. Seller may replace defective merchandise with new merchandise or may repair defective merchandise at its option.

This warranty gives you specific legal rights and you may also have other rights, which vary from state to state. Some states do not allow limitations on Implied Warranties, so the limitations stated above may not apply to you. Some states do not allow the exclusion or limitation of Incidental or Consequential damages, so the above limitation may not apply to you.
