This Limited Warranty is given to the original purchaser by Creative Energies, for the below specified periods from date of purchase. Creative Energies will replace or repair, at its discretion, parts that are defective in material or workmanship. This warranty does not cover the following: damage from misuse or neglect, wind damage, defects attributable to or resulting from normal wear and tear, alterations or negligence, units which have been modified or incorporated into other products or damages sustained by anyone other than the original purchaser. This warranty is non-transferable.

For the top and the side curtains, Creative Energies will repair or replace the top or side curtains without charge to the customer for a period of ninety (90) days from the date of purchase. After the ninetieth (90^th) day, Creative Energies will provide a credit against the cost of replacement of the defective part equal to the retail price of the defective part in effect as of the date of receipt of the defective part by Creative Energies, multiplied by a fraction, the numerator of which is determined by subtracting the number of months (including fractional parts) elapsed since the date of purchase from twenty-four (24) and the denominator of which is twenty-four (24).

For frame components and all other components (“miscellaneous components”) other than the top and the side curtains, Creative Energies will repair or replace the frame components and miscellaneous components without charge to the customer for a period of one hundred eighty (180) days from the date of purchase. After the one hundred eightieth (180^th) day, Creative Energies will provide a credit against the cost of replacement of the defective part equal to the retail price of the defective part in effect as of the date of receipt of the defective part by Creative Energies, multiplied by a fraction, the numerator of which is determined by subtracting the number of months (including fractional parts) elapsed since the date of purchase from thirty-six (36) and the denominator of which is thirty (30).

In order to obtain warranty service, call Creative Energies at 1-352-351-9448 to obtain an authorized number. Properly pack your defective parts. We recommend using the original carton and packing materials. Include in the package a copy of the sales receipt or other evidence of the date of original purchase. Also include your name and address and description of the defect. Ship the defective parts to Creative Energies. Make sure that you include your authorization number on the address label of the package and insure the package for full value. All packages received without an authorization number will be refused.

IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE ARE EXPRESSLY DISCLAIMED, CREATIVE ENERGIES SHALL NOT BE RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER DIRECT OR INDIRECT, AND WHETHER ARISING IN CONTACT OR IN TORT.

This warranty gives you specific legal rights and you may also have other rights, which vary from state to state. Some states do not allow limitations on Implied Warranties, so the limitations stated above may not apply to you. Some states do not allow the exclusion or limitation of Incidental or Consequential damages, so the above limitation may not apply to you.
